Terms of Service

These Terms of Service ("Terms") govern your use of the LiveGasCost mobile application and related services ("LiveGasCost", the "app"). The app is operated by Live Gas Cost LLC, a Wisconsin limited liability company ("we", "us"). By using the app you agree to these Terms. If you do not agree, do not use the app.

1. What LiveGasCost is for

LiveGasCost is a tool for personal trip cost tracking only. It estimates what a driving trip costs in fuel, and lets you log and review your own trips. It is intended for individual, personal use — not for commercial dispatch, fleet management, safety-critical, or regulatory purposes.

2. Who may use the app

You must be at least 13 years old to use the app. If you are under 18, use it only with a parent or guardian's permission.

3. Your license

We grant you a personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control. The app is licensed to you, not sold. You may not copy, redistribute, sell, rent, reverse engineer, decompile, or make derivative works from the app, except where the law says we cannot restrict that.

4. Location data and background tracking

LiveGasCost collects GPS location only while a trip is recording. If you grant background ("Always") location access, recording continues while the app is in the background or closed, so a drive is not cut short when your screen turns off. If you turn on automatic drive detection, the app may also start recording when it detects that you are driving. When no trip is recording, the app does not collect your location. You can revoke background access or turn drive detection off at any time. See our Privacy Policy for details.

5. Fuel prices are estimates (EIA)

Fuel prices shown in the app are sourced from the U.S. Energy Information Administration (EIA) regional average data. These are regional averages and may not match the price at any particular station or at the time you drive. We make no guarantee of the accuracy, completeness, or timeliness of fuel price data.

6. MPG data is an estimate (EPA)

Vehicle fuel-economy (MPG) figures are sourced from the U.S. Environmental Protection Agency (EPA) database. Actual fuel economy varies with your driving style, vehicle condition, load, weather, terrain, and other factors. EPA figures are estimates and are not a promise of the mileage you will achieve.

7. Cost calculations are estimates only

All trip cost figures, cost-per-mile values, fuel-used amounts, and related calculations are estimates produced from the data above and from your inputs. They are provided for general informational purposes and are not guaranteed to be accurate. Do not rely on them as exact financial figures.

8. No liability for financial decisions

You are solely responsible for any decisions you make. To the fullest extent permitted by law, we are not liable for any financial or other decisions made based on information provided by the app, including budgeting, reimbursement, pricing, or purchasing decisions.

To the fullest extent permitted by law, our total combined liability for all claims arising out of or relating to the app will not exceed the amount you actually paid us for the app. If you paid nothing, our total liability is zero.

9. Indemnification

If your misuse of the app, your violation of these Terms, or your violation of any law or third-party right causes a claim against us, you agree to defend us and cover the resulting damages and reasonable costs.

10. Safety — do not use while driving

Do not interact with the app while operating a vehicle. You are responsible for driving safely and for complying with all traffic and distracted-driving laws. To the fullest extent permitted by law, we are not liable for any accidents, injuries, death, or damage to property that occur while you use the app, including while driving. By using the app you assume all responsibility and risk for your own conduct.

11. Your records are yours to check

LiveGasCost does not provide tax, legal, or accounting advice. The app records what your drives cost in fuel. It does not produce tax reports, deduction figures, or any document intended for filing, and nothing it shows you should be relied on for a tax, reimbursement, or accounting purpose without your own review and, where it matters, advice from a qualified professional.

12. Purchases

The app sells one-time purchases only: an unlock for the live gas cost, and an unlock for the full app. There is no subscription, no auto-renewal, and no recurring charge of any kind; the current prices are on our Pricing page. Purchases are processed by the App Store or the Android store you installed from and are governed by that store's terms — we do not process or store your payment details. Anyone who bought the live-cost unlock before the full-app tier existed receives the full app at no additional charge, permanently.

Because each unlock is a one-time purchase it does not expire and there is nothing to cancel. It is tied to the store account you bought it with, so restoring it on a new device is done through that store's normal restore-purchases flow. Refunds are handled by the store under its refund policy, not by us.

Purchases are made through Google Play or Apple's App Store, and refunds are handled by the store under the store's own rules. Apple and Google are not parties to these Terms, but they (and their subsidiaries) are third-party beneficiaries of this section and of "Your license", and may enforce them.

13. Third-party data and attribution

Maps in the app are rendered from OpenStreetMap data: Map data © OpenStreetMap contributors, available under the Open Database License (ODbL). Place names are resolved from a bundled GeoNames data set: Place data © GeoNames, licensed under CC BY 4.0. Fuel prices come from the U.S. Energy Information Administration and vehicle fuel-economy figures from the U.S. Environmental Protection Agency. These sources do not endorse LiveGasCost.

14. No warranty

The app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or secure.

15. Availability and discontinuation of the service

We may modify, suspend, or discontinue the app, or any part of it, temporarily or permanently, at any time and with or without notice, and we will not be liable to you or anyone else for doing so. Because your trips are stored on your device and never reach us, discontinuing the app does not delete the records held on your phone.

Your drives live on your phone, and no copy of them ever reaches us — which also means we cannot recover them. Backups and exports are yours to make. If you delete the app or your data, we cannot restore it.

16. Acceptable use

There is no account to secure — the app has no sign-in. You agree not to misuse the app, including attempting to disrupt it, tamper with the purchase or unlock mechanism, or use the app in violation of any law.

17. Termination

We may discontinue your access to the app at any time, at our sole discretion, with or without notice — including for abuse, fraud, or violation of these Terms. Because there is no account, you end your relationship with us simply by deleting the app, which also deletes the drives stored on your phone. Any refund of the one-time purchase is handled by the store you bought it from, under its policy.

18. Changes to these Terms

We may update these Terms at any time. The current version and its date are always at the top of this page, and material changes will be noted there. Because the app has no account and no sign-in, there is no in-app acceptance step: your continued use of the app after an update means you accept the revised Terms.

19. Governing law

These Terms are governed by the laws of the State of Wisconsin, USA, without regard to its conflict-of-laws rules. Any disputes will be subject to the courts located in Wisconsin, to the extent permitted by law.

20. Feedback

If you send us ideas or suggestions, we may use them to improve the app without owing you anything — and we do appreciate them.

21. The usual legal housekeeping

If any part of these Terms turns out to be unenforceable, the rest stays in effect, and the unenforceable part is read as close to its intent as the law allows. These Terms are the entire agreement between you and us about the app. If we don't enforce a part of these Terms at some moment, we are not giving it up — we may enforce it later. Sections that by their nature should outlive your use of the app — estimates, liability, indemnification, governing law — survive it.
